Welcome to Las Vegas NV Driving School /LasVegasNVDriversEd.com. This agreement (“Agreement”) is a contract between you and Las Vegas NV Driving School dba LasVegasNVDriversEd.com (“Las Vegas nv Driving School / LasVegasNVDriversEd.com”). It governs your use of the LasVegasNVDriversEd.com Website, all uploads and all your activity on the LasVegasNVDriversEd.com Website. By creating an account and accepting this Agreement, you represent that you have read and understood this Agreement and agree to be bound by its terms and conditions.
1.ACCEPTANCE OF TERMS
LasVegasNVDriversEd.com may from time to time amend, supplement or modify the terms of this Agreement, and will post a copy of such amended Agreement on its Website. If you do not agree to be bound by (or cannot comply with) this Agreement, and any amendments thereto, your only remedy is to cancel your LasVegasNVDriversEd.com subscription and/or associate account. You will be deemed to have accepted this Agreement and any amendments, supplements or modifications thereto, if you continue to use the Service.
It shall be your sole obligation to periodically check the Website for any amendments, supplements or modifications to this Agreement and LasVegasNVDriversEd.com shall not be obligated in any way to notify you of any amendments, supplements or modifications.
2. DESCRIPTION OF SERVICE
The Service is available at the LasVegasNVDriversEd.com Website and includes everything on the site that may exist from time to time. Part of the Service makes available to you an associate center program (the “Program”). To join the Program, you must fill out the appropriate information to create a user account and LasVegasNVDriversEd.com must approve your account to join the Program. LasVegasNVDriversEd.com reserves the right to refuse participation in the Program to anyone. After you have created an completed your account process including completing your profile and your account is accepted, you will have access to the various products and links. If you do not follow the link that was provided for email verification during your registration, your account may be cancelled without notice until you register again, confirm your email address, pay for the course part 1 and complete your profile.

3. Service Availability:
The Company will strive to provide a consistent level of service availability and performance, but will not be liable for failure or delay in performance obligations due to circumstances beyond its control. This includes but is not limited to acts of war, sabotage, fire, flood, strike, unavailability or delay of third party services, Webshost, ISP , hackers or virus attack, or power used by the equipment needed. The Company will not be held liable for any errors, damage, or other unexpected events resulting from the use of the Service.
3. YOUR REGISTRATION OBLIGATIONS
To use the Service, you must register by creating an account and provide certain information to LasVegasNVDriversEd.com (“Registration Data”). You agree to provide true, accurate, current and complete Registration Data at the time you register and that you will update your Registration Data as necessary to keep it true, accurate, current and complete. For security reasons, your profile will be hidden following completion of the profile. If you have to modify your profile you agree to contact the administration of this company for any necessary update. LasVegasNVDriversEd.com will use your Registration Data in accordance with its privacy policy. By clicking on “Register” at the end of the creation of your account and using the LasVegasNVDriversEd.com Website and Service, you effectively acknowledge and accept the terms of the privacy policy.
You are responsible for maintaining the confidentiality of the password and account, and are fully responsible for all activities that occur under your password or account, including but not limited to the confidentiality of your personal questions (favorites) requested prior each quiz for proof of identification. You agree to immediately notify LasVegasNVDriversEd.com of any unauthorized use of your password or user account or any other breach of security, and ensure that you exit from your account (log out) at the end of each session.
You agree that you will not allow others to use your member name, password and/or answers to personal favorite questions that are posted before each quiz for proof of identification. Failure to correctly respond to any personal identification question may stop you from obtaining your final approval for the certificate of completion. You acknowledge that you will receive a notice of failure only at the end of the course prior receiving your Certificate of Completion; even so you successfully passed your final exam. You agree that you may have to redo any/or all quizzes if you fail to provide an accurate proof of identity, regardless of successfully passing any quiz.
You agree to allow a certain time after the final exam to receive your certificate of completion. You recognize that upon finishing your final exam, you will need to download and print a statement to certify by Law that you did the course by yourself. Your parent (or guardian) and yourself must sign this statement in front of a Notary Public and send the original notarized statement back to this company to admin@lasvegasnvdriversed.com that is the email address stipulated on the statement. Be aware that this services may be closed on weekend or holidays.
You understand that anything can happen with electronics (power failure, computer failure, web server virus, malware or hacker attack, Webhost closing down, security software closing down the website, etc etc..That may delay the sending of your certificate. Las Vegas NV Driving School and Las Vegas NV Drivers Ed will do everything they can to send you the certificate as fast as possible and will not be responsible for any delay in receiving your certificate
You agree to receive your Certificate of Completion by email following the delivery of your original notarized statement, and you are thereby advised to schedule your DMV driving test appointment at least 2 to 3 working days after mailing back your Notarized Statement. Consider passing your exam at least 36 or 48 hour (more on weekends) prior your DMV appointment.
Las Vegas NV Driving School or LasVegasNVDriversEd.com, its employee’s or administrators cannot and will not be liable for any delay, loss or damage arising from your failure to comply with this Section.
4. USE OF SERVICES
You may use the Service only in accordance with the terms and conditions of this Agreement and any amendments as well as any additional terms that may be presented in connection with any particular feature or function of the Service from time to time.
5. CONTENT
You understand that all data and messages or other materials (“Content”), whether publicly posted or privately transmitted, are the sole responsibility of the person from which such Content originated. This means that you, and not LasVegasNVDriversEd.com, are entirely responsible for all Content that you upload, post, transmit or otherwise make available via the Service.
LasVegasNVDriversEd.com does not control the Content uploaded via the Service and, as such, does not guarantee the accuracy, integrity or quality of such Content. Under no circumstances will LasVegasNVDriversEd.com be liable in any way for any Content, including, but not limited to, for any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, transmitted or otherwise made available via the Service.
You agree to not use the Service to:
a. upload, post, transmit or otherwise make available any Content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable;
b. upload, post, email, transmit or otherwise make available any Content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);
c. upload, post, email, transmit or otherwise make available any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights (“Rights”) of any party;
d. upload, post, email, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation; or
e. upload, post, email, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.
You acknowledge that LasVegasNVDriversEd.com may or may not pre-screen Content, but that LasVegasNVDriversEd.com and its designees shall have the right (but not the obligation) in their sole discretion to pre-screen, refuse, or move any Content that is available via the Service. Without limiting the foregoing, LasVegasNVDriversEd.com and its designees shall have the right to remove any Content that violates this Agreement or is otherwise objectionable. You agree that you must evaluate, and bear all risks associated with, the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content.
You acknowledge and agree that LasVegasNVDriversEd.com may store and/or disclose, as applicable, any such content or material it is required to do so by law, or has a good faith belief that such storage or disclosure is reasonably necessary to comply with court orders or other legal processes; to enforce this Agreement; to respond to any claims that such content violates any third party’s rights; or to protect the rights, property or personal safety of LasVegasNVDriversEd.com, its business partners, affiliates, licensors and/or licensees, any other LasVegasNVDriversEd.com subscriber or member, or the general public.
LasVegasNVDriversEd.com reserves the right to delete any data posted by its members, that is not accurate and unusable for the student records, or contributing to unnecessary data recording resulting in database clogging. This company cannot be held responsible for involuntary malfunction or loss of data due to loss of power, computer malfunction, error or virus infection. This company is doing regular backup but it is understood that this is not 100{24478e4b98e2619f6de9f2aadc58d6e55ee23fcdd9c4cd175117a419b4e939e6} reliable and this company or its employees and administrators cannot be held responsible in case of delay in a student performance or final exam. In such an event the student may have to redo the quizzes that have been damaged in such occurrences.
This company reserves the right to suspend or close without compensation any account that has been inactive for a certain time as it may be hampering with the service.
6. REPRESENTATIONS AND WARRANTIES
By using the Services, you expressly represent and warrant to LasVegasNVDriversEd.com that: (a) you have the power and authority to enter into and perform your obligations under this Agreement; (b) all information provided by you to LasVegasNVDriversEd.com is truthful, accurate and complete; and (c) you shall comply with all terms and conditions of this Agreement.
7. NO RESALE OF SERVICE
You agree not to reproduce, duplicate, distribute, copy, sell, trade, resell or exploit for any commercial purposes, any portion of the Service, use of the Service, or your user name or password.
8. MODIFICATIONS TO SERVICE
LasVegasNVDriversEd.com reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that neither LasVegasNVDriversEd.com nor its affiliates shall be liable to you or to any third party for any modification, suspension or discontinuance of the Service.
9. INDEMNITY
You agree to indemnify and hold LasVegasNVDriversEd.com and/or Las Vegas NV Driving School, its partners, parents, subsidiaries, officers, directors, agents, affiliates, webmasters, employees and/or licensors, as applicable, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of Content you submit, post, transmit or make available through the Service, your use of the Service, your connection to the Service, your violation of this Agreement, or your violation of any rights of another.
9b. TERMS OF PAYMENT AGREEMENT
We are using Paypal as our online banking system. Upon your acceptance to pay for the course you will be transferred on a Paypal secured page fopr the payment and lasvegasnvdrivingschool is not responsible for any problem with Paypal transactions.
You are not obligated to open an account with Paypal but are welcome to use one if you are registered with them.
You are using Paypal services to pay with your own credit or debit card.
lasvegasnvdrivingschool or lasvegasnvdriversed cannot be responsible with problem occurring related to yourpayment.
You agree to authorize Paypal to charge the indicated credit or debit card for payment for services offered.
You agree that once a payment is accepted and registered there will be no cancellation an no refund accepted.
The course ia payable in two parts to allows student 18 years of age or more to bypass the exam (part-2)as they do not need.
You are not obligated to pay for part2-exam if you decide to quit after the course part-1. Once a payment has been made, the company will not offer any refund or compensation for any reason.
10. COPYRIGHT INFORMATION
You must acknowledge and agree that the Service and any necessary software used in connection with the Service contain proprietary and confidential information that is protected by applicable intellectual property and other laws. You further acknowledge and agree that Content contained in sponsor advertisements or information presented to you through the Service or advertisers is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. You agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the Service, in whole or in part. By clicking on “I Agree” at the end of the creation of your associate account and using this LasVegasNVDriversEd.com website and Service, you effectively acknowledge and accept the terms of the copyright notice.
11. TRADEMARK
LasVegasNVDriversEd.com product names, logos, commercial symbols, trade names and slogans are trademarks of LasVegasNVDriversEd.com and are protected by U.S. and international trademark laws. You are prohibited from using any of the marks appearing on this Website without the express prior written consent of LasVegasNVDriversEd.com, except as permitted by applicable laws. The other marks and logos shown on this Website may be marks owned by third parties that are not affiliated with LasVegasNVDriversEd.com. Such marks appear for identification purposes only and are the property of their respective companies. Nothing shown on this Website should be construed as granting, by implication, estoppels or otherwise, any permission, license or right to use any trademark, service mark or trade name displayed on this Website without the written permission of LasVegasNVDriversEd.com or the third party that may own the trademark, service mark or trade name at issue. LasVegasNVDriversEd.com prohibits, without prior LasVegasNVDriversEd.com written consent, the use of any LasVegasNVDriversEd.com logo or mark as a hyperlink to this Website or any other LasVegasNVDriversEd.com website.
12. VIOLATION OF INTELLECTUAL PROPERTY RIGHTS
LasVegasNVDriversEd.com respects the intellectual property of others, and we ask our users to do the same. If LasVegasNVDriversEd.com (a) receives a notice alleging that you have engaged in infringing behavior or (b) reasonably suspects that your use of the Service or the uploads violates LasVegasNVDriversEd.com’s or others’ intellectual property rights, LasVegasNVDriversEd.com may, in its sole discretion, suspend or terminate your account with or without notice to you.
13. OBJECTIONABLE OR EXPLICIT CONTENT
LasVegasNVDriversEd.com is not responsible to you for any content or materials constituting all or part of any uploads or any other aspect of the Service that you might find objectionable.
14. TERMINATION, CANCELLATION AND PLAN CHANGES
LasVegasNVDriversEd.com may in its sole discretion terminate this Agreement or suspend your user account at any time with or without notice to you in the event that you breach (or LasVegasNVDriversEd.com reasonably suspects that you have breached) any provision of this Agreement. You understand and agree that your cancellation of your associate account is your sole right and remedy with respect to any dispute with LasVegasNVDriversEd.com. This includes, but is not limited to, any dispute related to or arising out of: (1) any term of this Agreement or LasVegasNVDriversEd.com’s enforcement or application of the same; (2) any policy or practice of LasVegasNVDriversEd.com, including its Privacy Policy and Copyright Notice, or LasVegasNVDriversEd.com’s enforcement or application of these policies. LasVegasNVDriversEd.com reserves the right to approve or disapprove all new accounts and discount codes created by the associate. User acknowledges that the member’s account will be locked from external access following successfully passing the drivers’ education exam and downloading the Notarized Statement, even so the registration stipulates a later closing date or infinite service. LasVegasNVDriversEd.com may also deactivate accounts and codes for any reason after a 12 month time period from inception of the account and code.
Associate fees earned during the term, and associate fees earned through the date of termination that are pending but not paid out will no longer be available for payout, if the associate account is terminated for any reason. You are responsible for making sure you have requested payment for all pending associate fees prior to terminating your associate account.
15. DISCLAIMER
You understand and agree that your use of the Service and the uploads /downloads is at your own sole risk. THE SERVICE AND THE UPLOADS ARE PROVIDED “AS IS” AND WITHOUT WARRANTY BY LasVegasNVDriversEd.com OR ITS AGENTS, EMPLOYEES, PARENTS, SUBSIDIARIES, OFFICERS, DIRECTORS, AFFILIATES, LICENSORS, BUSINESS PARTNERS AND/OR SUPPLIERS (THE “LasVegasNVDriversEd.com ENTITIES”), AS APPLICABLE, AND, TO THE MAXIMUM EXTENT ALLOWED BY APPLICABLE LAW, LasVegasNVDriversEd.com AND THE LasVegasNVDriversEd.com ENTITIES, AS APPLICABLE, EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND ANY WARRANTY OF NONINFRINGEMENT.

UNDER NO CIRCUMSTANCES SHALL LasVegasNVDriversEd.com AND/OR THE Las Vegas NV Driving School ENTITIES AS APPLICABLE, BE LIABLE TO YOU FOR ANY CONSEQUENTIAL, INCIDENTAL OR SPECIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE SERVICE AND/OR THE UPLOADS, EVEN IF LasVegasNVDriversEd.com AND/OR THE LasVegasNVDriversEd.com ENTITIES AS APPLICABLE, HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
18. NO THIRD PARTY BENEFICIARIES
You agree that, except as otherwise expressly provided in this Agreement, there shall be no third party beneficiaries to this Agreement.
19. LAW AND LEGAL NOTICES
This Agreement constitutes the entire agreement between you and LasVegasNVDriversEd.com and governs your use of the Service, superseding any prior agreements between you and LasVegasNVDriversEd.com. You understand and agree that, except as expressly set forth herein, this Agreement is not intended to confer and does not confer any rights or remedies upon any person other than the parties to this Agreement.
This Agreement and the relationship between you and LasVegasNVDriversEd.com shall be governed by the laws of the State of California without regard to its conflict of law provisions. You and LasVegasNVDriversEd.com agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Alameda, California in connection with any such dispute including any claim involving LasVegasNVDriversEd.com or its partners, parents, licensors, affiliates, subsidiaries, employees, contractors, agents, officers, directors or suppliers.
The failure of LasVegasNVDriversEd.com to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. If any provision of this Agreement is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of this Agreement remain in full force and effect.
You agree that your LasVegasNVDriversEd.com user account is non-transferable and any rights to your user account or contents within your user account terminate upon your death. Upon receipt of a copy of a death certificate, your associate account may be terminated and all contents therein permanently deleted.
You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or this Agreement must be filed within one (1) year after such claim or cause of action arose or be forever barred.
The headings used in this Agreement are for convenience only, and will have no effect on the interpretation or legal enforceability of the terms herein.
